Terms & ConditionsThe lessor called "Beau Monde Service", hereby rents vehicle to the mentioned Renter, subject to all terms and conditions of the agreement printed and the Renter agrees to them all and confirms that he will strictly comply with them. All additions or changes to the Agreement must be in writing and signed on Beau Monde's behalf by authorized representative.
The Renter agrees that the vehicle is in good overall and operating condition without apparent defects. Any complaints to the vehicle conditions must be put on the special list and signed both by the lessor and the Renter at the beginning of the rental. The renter agrees to return the vehicle in the same condition as well as all documents and accessories on the date and at the location, designated in this agreement. The Renter agrees that late return of the car at the location and time designated (24 hours after the designated time) may be judged as a deliberate theft. In that case the Lessor may initiate a legal procedure or open a case in accordance with the current Code of the Republic of Armenia. In case of the late return and in if a legal procedure started, the Renter agrees to pay the forfeit apart from the rental charges. The forfeit goes up to 20% of the rental charges for one rental day for every day beyond the rental period (in accordance with Civil Code of the Republic of Armenia. The Lessor reserves the right to repossess the vehicle at any time without telling the Renter and without demand at Renter's expense if the vehicle is used in violation of this Agreement. In the case if the Renter is responsible for his own property which was left in the vehicle at the time it was repossessed.
In case of loss, damage or theft of the vehicle or parts of it the Renter shall pay the Lessor or demand the amount of all resulting damage loss in value (including but not limited to replacement or recovery costs, repair costs, compensation for decline in value), irrespective of his or the driver's fault, if the Renter or the Driver violated these Standard Rental Terms and Conditions any legal provisions (including customs and driving regulations) or insurance regulations.
Liability for loss or damage to the vehicle may be limited to the amount stated Lessor's current tariff if the Renter accepts CDW (Collision Damage Waiver), which limits Renter's responsibility in case of damage, by initialing the space "ACCEPT" on the front page and paying the daily charge specified. However CDW only applies if you have complied with all terms where CDW is declined the Renter becomes fully responsible for cost of repairing or replacing the Beau Monde Service vehicle (including parts, labour, towing, storage and any administrative charges). - Liability for loss or damage of the vehicle by theft may be limited to the amount stated tariff if the Renter accepts TP (Theft Protection) which limits Renter's responsibility by initiating the space "ACCEPT" on the front page and paying the daily charge specified. Both CDW and TP are not insurance.
The Lessor has to give the vehicle in good overall and operating conditions. The Lessor is not responsible for any loss or damage suffered by the Renter.
Renter is responsible for payment of all charges billed. All charges are calculated according to current tariff and on the basis of vehicle use terms. Unauthorized use or damage may incur additional chargers as stated in current tariff of the lessor Renter agrees to pay on demand charges as printed below. a) Rental and other charges, such as CDW, TF, additional drivers and taxes. The minimum rental charge is for one rental day. A rental day starts when the rental begin and lasts 24 hours. In case of late return of the vehicle (exceeding 60 minutes) Lessor reserves the right to make an additional charge daily rental tariff, b) any charge for damage as outlined in clause 2, including the non-waivable amount, c) vehicle delivery and return charges according to relevant tariff as well as airport fees, d) refueling service charges according (to relevant tariff in case Renter returns the vehicle with less than a full tank of fuel. This charge is not a sale of fuel, e) applicable taxes imposed by operating law, f) the actual repair costs of the damage discovered after the vehicle return caused at Renters fault Hereby, Renter agrees to exclusive right of lessor to determine the party being at fault, g) any other charges for occasional service as Stated in this paper.
Payment is to be made:
in case of a credit card withdrawal of funds is performed in AMD at the exchange rate of the Central Bank of Armenia on the date of vehicle rental.
Renter agrees to pay the charges as and when billed. In case if the charges are not paid on time Renter may be subject to additional penalties of 20% (annual) on top of the sum but not less than AMD 25000 (approx. US$50).
Any complaints or queries of the Renter relating to any charges must be submitted to Lessor within 15 days of receipt of a statement of charges, otherwise they will be rejected.
Transfer from/to Airport charge is AMD 9000 (approx. US$20) (Night shift is AMD 15000 approx. $30).
Checking in/out in non-working days and hours is charged additionally AMD 5000 (approx. US$10).
In case, if the renter refuses to take the car after the agreement is signed, Beau Monde Service preserves the right to keep 20% of the car rental price.
Lost of any document or key - AMD 150000 (approx. US$350).
The Renter agrees to look after the car carefully, lock it and use any security device fitted. Key and documents to the car must be in Renter possession and under his permanent control. The Renter must not allow the vehicle to be used: a) to carry passengers or cargo for remuneration, b) to tow or push am vehicle, trailer or other object, c) to take part in a race, rally, test or any other contest d) under the influence of alcohol, drugs, barbiturates, medicines causing hallucination or other absorbed elements which may adversely affect a person's ability to drive safely or allow any such person to operate the car, e) in contra version of any customs and traffic or other regulation, f) by any person other than Renter unless that person is designated and authorized by the Lessor on the front page of this agreement and in authorized supplements to the agreement: g) to drive beyond the limits of Armenia without a special permission of Lessor’s representative, h) for sub-renting.
The Renter confirms that he corresponds to the requirements regarding age (21 years old), driving experience (min 3 years), has a valid driving license, passport and a valid credit card (ARCA, VISA and MASTER).
The Lessor provides insurance coverage for persons using the vehicle with its permissions (and no otherwise) in accordance with an automobile liability insurance policy and existing tariff limits. The insurance policy is available for inspection on demand. This policy meets all applicable statutory requirements and protects the owner and for any authorized driver of the vehicle against legal claims from third parties. The conditions of the insurance contract are incorporated as an integral part of this agreement.
In case of an accident (with or without damage to the vehicle) and in case of any personal injuries, the Renter must call road police and obtain a "Protocol" which he must bring to Lessor. Any accident or damage or loss or theft of the vehicle must be reported to the Lessor immediately. The Renter must secure all datas of all other parties as well as of any witnesses in order to complete the said accident report. Under any circumstances the Renter must not accept claims by third parties. The Renter is obliged to assist the lessor and / or insurance companies in all claims or legal procedures with regard to accident or any damage. In case of the theft the Renter is obliged to return a set of original keys with a car alarm remote vehicle registration papers as well as a theft report made up, registered and signed by the Police. If the Renter violates any of these regulations, especially if no Protocol or Report can be presented to the Lessor, even an accepted and paid CDW or TP may not release Renters from indemnities.
This agreement is made in accordance with the laws of the country of residence of the Lessor and all that may arise out of' or in connection with this agreement shall fall within the non-jurisdiction of any court having responsibility for such matters in country of residence of the Lessor. This agreement is made in English and Armenian and both have the same legal status.
In the case of cancelling 7 days or more prior to your arrival date, no cancellation penalties will be incurred. Any cancellations made less than 7 days prior to arrival date, a penalty charge equivalent to 30% of your booking value will be incurred. If you do not show, you may be charged 100% of your booking value.
The renter should attentively look after all the precaution lights and dashboard signs in the car In case of emergency precautions stop driving and inform the Lessor.
